Private Vehicle Rentals

1. Definitions & Eligibility

  • "Agreement" refers collectively to these Terms & Conditions, the rental agreement, reservation details, and any supplementary documentation provided at the time of rental.

  • "Vehicle" refers to the rented vehicle and all included equipment, accessories, keys, documentation, and contents provided at the start of the rental period.

  • "Renter" refers to the individual renting the Vehicle, any approved additional driver, and any person or organization responsible for payment under this Agreement.

  • "Authorized Driver" refers strictly to individuals approved by the company, listed on the rental agreement, who possess a valid driver's license and meet all age requirements.

Only Authorized Drivers may operate the Vehicle. Providing false, misleading, or fraudulent information to bypass eligibility requirements constitutes a material breach of contract and will result in the immediate termination of the rental without a refund.

2. Vehicle Condition, Maintenance & Return Policy

The Renter acknowledges receiving the Vehicle in good operating condition and agrees to return it in the exact same condition, excluding normal wear and tear, to the designated location on the date and time specified.

  • General Upkeep: The Renter is responsible for maintaining proper fuel, fluid levels, and general care during the rental period. Unauthorized repairs or modifications are strictly prohibited.

  • Fuel Policy: The Vehicle must be returned with the same fuel level provided at pickup. Refueling charges and service fees will apply if returned with less fuel.

  • Cleaning & Smoking Policy: Vehicles must be returned in a reasonably clean condition. Smoking, vaping, marijuana use, or the use of any illegal substances inside the Vehicle is strictly prohibited. Excessive dirt, stains, pet hair, odors, smoke residue, spills, or biohazard contamination will result in professional cleaning and restoration fees.

  • Late Returns: A 30-minute grace period is provided. Returns exceeding this grace period will incur a late fee of $150 per hour. Failure to return the Vehicle as agreed may result in additional rental charges, recovery fees, towing fees, and repossession expenses.

3. Mileage, Tolls & Violations

  • Mileage Policy: Each rental includes 150 miles. Additional mileage is charged at a rate of $3.00 per mile. Odometer tampering, alteration, or interference is strictly prohibited and will result in severe additional penalties.

  • Fines & Citations: The Renter is solely responsible for all tolls, parking tickets, traffic citations, camera violations, and impound fees incurred during the rental period.

  • Administrative Fees: If the company processes or pays any such violations on the Renter's behalf, the Renter authorizes the company to charge the payment method on file for the full amount plus applicable administrative processing fees.

4. Prohibited Uses

The Vehicle must be operated in a safe, lawful manner. Any of the following actions constitute a material breach of this Agreement, resulting in immediate termination of the rental, repossession of the Vehicle, and the voiding of any optional protection products.

The Vehicle may not be used:

  • By anyone who is not explicitly listed as an Authorized Driver.

  • While under the influence of alcohol, drugs, or any impairing medication.

  • For racing, drifting, speed contests, burnouts, track events, or reckless/negligent driving.

  • For towing, pushing another vehicle, or driving off-road/on unmaintained roads.

  • To transport hazardous, illegal, dangerous materials, or more passengers than available seat belts.

  • To commit any criminal offense or violate local laws, including mobile device restrictions.

  • For ride-share, delivery, courier, or transportation-for-hire services unless expressly approved in writing.

5. Telematics, Driving Behavior & Speed Limits

5.1 Driving Behavior Limits

The following actions are strictly prohibited and will result in disciplinary consequences:

  • Tampering with, removing, disabling, or otherwise interfering with any tracking, GPS, or telematics device.

  • Tampering with, removing, disabling, obstructing, or impeding any vehicle camera or monitoring equipment.

  • Operating the vehicle at speeds exceeding 90 mph.

  • Repeated hard acceleration, aggressive driving, or hard braking events.

The Renter is entitled to exactly one (1) total warning across all driving behavior categories. Following that initial warning, any subsequent violation—regardless of category—may result in the immediate forfeiture of your security deposit, early termination of the rental, and repossession of the vehicle at our sole discretion and at your expense.

5.2 Speeds Over 100 mph

If onboard telematics data records the vehicle traveling at 100 mph or higher, the Renter will be charged up to $500 per occurrence. This fee is based on a reasonable estimate of accelerated vehicle wear, increased insurance exposure, administrative costs, and inspection expenses.

In addition, the Renter is responsible for the full cost of a comprehensive mechanical and safety inspection, alongside any repairs deemed necessary as a result of such high-speed operation. The $500 fee applies strictly to the per-occurrence violation charge and does not limit your financial responsibility for actual physical damages. Any damage, mechanical failure, excessive wear, loss of value, or other resulting costs will be governed by the damage liability provisions outlines in Section 6 of this Agreement.

6. Damage, Accidents & Insurance

  • Renter Responsibility: The Renter is financially responsible for all damage, loss, theft, vandalism, or misuse occurring during the rental period, regardless of fault. This responsibility includes actual repair costs, diminished vehicle value, loss of use, towing, storage, and administrative fees. If the vehicle is declared a total loss, the Renter is liable for the vehicle’s fair market value, less salvage.

  • Insurance Coverage: The Renter must understand their own auto insurance coverage before operating the Vehicle. Any optional protection plans offered are subject to separate terms, and the Renter remains responsible for any losses not covered by insurance.

  • Mandatory Accident Protocol: In the event of an accident, theft, or damage, the Renter must ensure safety, contact emergency services if necessary, notify the company immediately, complete an incident report, and cooperate fully with all subsequent investigations. Failure to report an incident promptly may result in additional liability.

7. Financial Authorizations & Repossession

  • Payment Authorization: By completing a reservation, the Renter authorizes the company to charge the payment method on file for all base rental fees, taxes, mileage overages, late fees, behavior violation/speeding fees, tolls, tickets, cleaning fees, damage costs, and any supplemental charges discovered during final post-rental inspection.

  • Right to Repossess: The company reserves the right to recover or repossess the Vehicle without prior notice if it is abandoned, unlawfully used, overdue, or operated in violation of any clause within this Agreement (including the telematics and driving behavior restrictions in Section 5).

8. Legalities & Liability Limitations

  • Personal Property: The company is not responsible for personal items left inside the Vehicle. Any property left behind is done so entirely at the owner's risk.

  • Limitation of Liability: To the fullest extent permitted by law, the company is not liable to the Renter or any third party for indirect, incidental, special, punitive, or consequential damages arising from the rental, use, or inability to use the Vehicle.

  • Governing Law: This Agreement shall be governed by and construed under the laws of the state in which the rental originates. Disputes must be resolved in the appropriate courts of that jurisdiction.

9. Acceptance of Terms

By completing a reservation, processing a payment, or taking physical possession of the Vehicle, the Renter acknowledges that they have read, understood, and agreed to all stipulations within these Terms & Conditions without exception or reservation.
